Any information provided to us is solely to assist you when using our site, products and services.

This information may include :

  • Bank or Credit Card information, which is handled only with the utmost security.
  • E-Mail via correspondence or our help desk
  • Web Site Usage data via "cookies" or server logs to improve site performance and provide you the statistics for your own optimisation.
  •  We offer a restricted client area, where you can share thoughts with other clients that are subject to the same confidentiality requirements.

Information may only be disclosed when legally compelled by law.

User Agreement

Terms of Service, TOS- By using this sites(InGenius Results) services constitutes agreement to these terms and policies. Violations of this TOS may result in account suspension or termination.

Account Setup

Your account will be setup after payment is made with the appropriate screening of order(s). It is your responsibility to provide us with a valid email address that can be used as a prime contact for any issues. False contact information of any kind may result in the termination of your account. InGenius Results reserves the right to refuse or discontinue service to anyone at sole discretion. Additional proof of identity may be required.

Content

The customer agrees to indemnify and hold harmless InGenius Results from any claims resulting from the use of our services. Use of our services for illegal activities (any activity that violates any international, foreign, federal, state, or local laws) or to infringe upon any copyright or trademark is prohibited.  Any material that, in our judgment, is obscene or threatening is prohibited and will be removed from our servers with or without notice. Violations will be reported to the appropriate law enforcement agency.

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly.  Users are ultimately responsible for all actions taken under their account. Audits may be done to identify insecure practices, at which time you will be notified and allowed time to change/update any risk.

SPAMof any form is not acceptable, including the sending of unsolicited e-mail, bulk emailing, Safe lists and "double opt-in". Consequently those listed at ROKSO will not be accepted and are subject to termination.

Payments

You agree to pay on time for the services received from InGenius Results in advance of the time period. Any overdue payment may be subject to a late fee and/or an account suspension/termination until account balance has been paid in full.
Any multiple payments with be registered as a credit towards the account.

Cancellation

You may cancel your account at any time by submitting a ticket to the Help Desk or email to support@ ingeniusresults.com. 30 days notice is required prior to the next billing date. There are no refunds or associated fees.

Backups and Data Loss

Use of these services is at your sole risk. InGenius Results is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on your account.

Resource Usage

User may not damage, disable, overburden or impair operations. Thus, you may not: a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc. b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed. c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD. d) Run any software that interfaces with an IRC (Internet Relay Chat) network. e) Run any bit torrent application, tracker, or client. Please note that you may link to torrents off server, but may not host or store them. f) Participate in any file-sharing/peer-to-peer activities g) Run any gaming servers such as counter-strike, half-life, etc h) Run cron entries with intervals of less than 15 minutes

When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include("http://yourdomain.com/include.php") use include("include.php")

INODES

The use of more then 50,000 INODES will result in account suspension. Accounts found exceeding 50,000 INODES will not be backed up on our backup servers. A INODE is the actual file or directory and not the size of that file or directory. For example your index.html file is 1 INODE. A directory called homework is counted as 1 INODE as well.

Bandwidth Usage

If you are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is allocated, or upgraded to a higher level of package. Unused transfer in one month cannot be carried over to the next month.

Arbitration

If any disputes or claims greater than $250.00 arise against Ingenius Results or its subsidiaries, such disputes will be handled by an arbitrator of Ingenius Results's choice. All decisions rendered by that arbitrator will be binding and final. You are also responsible for any and all costs related to such arbitration.

Disclaimer

InGenius Results shall not be responsible for any damages your business may suffer. InGenius Results makes no warranties of any kind, expressed or implied for services we provide. InGenius Results disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by InGenius Results and its employees.

Service Level Agreement

InGenius Results is committed to providing a high level of service. The Service Level Agreement (SLA) policy is that InGenius Results shall not be liable for any upstream problems outside of its network. The guarantee is that its network will be available to Customer free of Network Outages, that render 100% packet loss, 99.9% of each calendar month. Scheduled Downtime, scheduled interruption of Services, will include as much notice as possible. Please notify support@ingeniusresults.com if you do experience any downtime.
